Terms and conditions regarding our Exclusivity Emails.

1. The following clauses relate to pre-contract exclusivity agreements entered into between Xtra IT Resources Ltd (“Xtra”) and its proposed consultants.

The consultants or any company through which the consultants trade (“the trading company”) shall immediately inform Xtra in writing should the consultant or the trading company at any time during the currency of the exclusivity agreement or in the twelve months thereafter receive an approach from any company, associated company or subsidiary in respect of whom Xtra have offered the services of the consultant or the trading company in accordance with the terms of the exclusivity agreement if any offer of engagement, employment or the purchase of services is offered to the consultant or the trading company.
   
   
3. In the event that the consultant shall fail to adhere to clause 2 above, the consultant shall become liable for such loss as Xtra shall suffer by virtue of any failure by the client, its associated companies or subsidiaries to pay such commission as Xtra should or would ordinarily have become entitled by virtue of its agreement with that client.
